General terms and conditions for consumers

With the execution of the order you accept our general terms and conditions.

These terms and conditions govern your rights but also obligations in dealing with us. We strive to always behave fairly and customer-oriented and hope ourselves that we never have to insist on compliance with these terms and conditions.

At the same time, the following GTC contain legal information about your rights according to the regulations on contracts in distance selling and electronic commerce.

 

1. scope

1.1 For all deliveries of Tender-Connect Shop to consumers (§ 13 BGB) these General Terms and Conditions (GTC) apply.

 

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to his or her commercial or independent professional activity.

1.2 These General Terms and Conditions shall always apply to all mutual claims arising from and in connection with the conclusion of a contract between business customers who are not consumers within the meaning of § 13 BGB (German Civil Code) and s4u Gmbh.

1.3 In the event of conflicts, the order of precedence between the regulations shall be:

3. offer and conclusion of contract

3.1 The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to order. Errors excepted.

3.2 By clicking the button [Order] you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.

4. right of withdrawal

4.1 Consumers have a fourteen-day right of withdrawal.

 

Start revocation policy 

Right of revocation You can revoke your contractual declaration within 14 days without giving reasons in writing (eg letter, fax, e-mail) or - if the goods are delivered before the deadline - by returning the goods. The period begins after receipt of this notification in writing, but not before receipt of the goods by the consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfill our obligations under Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations under § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB.

The timely dispatch of the revocation or the item is sufficient to comply with the revocation period.

Consequences of revocation

In the event of an effective revocation, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. If you are unable to return or surrender the received performance and benefits (e.g. benefits of use), or are only able to do so in part or in a deteriorated condition, you must compensate us for the loss of value. F

You are only obliged to pay compensation for the deterioration of the item and for any use made of it if the use or deterioration is due to handling of the item that goes beyond checking its properties and functionality.

Testing the properties and functionality" means testing and trying out the respective goods, such as is possible and customary in a retail store. Goods that can be sent by parcel are to be returned at our risk. You have to bear the regular costs of the return if the delivered goods correspond to the ordered goods.

Otherwise the return is free of charge for you. Items that cannot be sent by parcel post will be collected from you.

Obligations to refund payments must be fulfilled within 30 days.

The period begins for you with the dispatch of your revocation or the goods, for us with their receipt.

End of the cancellation policy 

The right of withdrawal does not apply to distance contracts - for the delivery of goods that are manufactured according to customer specifications or - are clearly tailored to personal needs or - are not suitable for return due to their nature or - can spoil quickly or - whose expiration date would be exceeded, - for the delivery of audio or video recordings or software, provided that the delivered data carriers have been unsealed by the consumer or - for the delivery of newspapers, magazines and periodicals, unless the consumer has made his contractual declaration by telephone.

4a. Return costs when exercising the right of withdrawal If you exercise your statutory right of withdrawal (see cancellation policy), you have to bear the regular costs of return if the delivered goods ordered. Otherwise, the return is free of charge for you.

5. prices and shipping costs

5.1 The prices stated on the product pages include the statutory value added tax and other price components.

5.2 Information on additional shipping costs can be found at the respective product. Depending on the order quantity, these are between € 6.90 and € 44.90.

5.3 For all price information applies expressly technical changes and errors excepted!

6. delivery

6.1 Delivery is made worldwide. Within Europe, the stated shipping costs apply. Deliveries to non-European countries are subject to a surcharge for shipping. These are dependent on the country and weight of the shipment and can not be specified exactly in advance.

6.2 Information on delivery times can be found on the respective product page.

7. payment

7.1 Payment is made optionally as indicated in the store.

7.2 You shall only be entitled to set-off if your counterclaims have been legally established by a court or are undisputed or have been acknowledged by us in writing.

7.3 You may only exercise a right of retention insofar as the claims result from the same contractual relationship.

8. retention of title

Until full payment, the goods remain our property.
